Attorney Jason Webster Wins Multimillion-Dollar Decision in Wrongful Death Case

On May 22, 2018, trial lawyer Jason Webster, founder and principal attorney of The Webster Law Firm, obtained a verdict in which his clients, Ginger Thompson and Brad Washington (plaintiffs), received $7,635,000. The case (Case No. 88970, filed in the District Court of Ellis County, Texas, 40th Judicial District) stems from the death of Ginger's and Brad's 14-year-old daughter, Avery Washington, who committed suicide as a result of medical negligence.

According to testimony and court documents, Avery Washington presented to Pediatrics Cool Care on March 1, 2012, and complained of depression. She was 14 years old at the time. The Physician Assistant, Jenelle Robinson, PA-C (defendant), under the supervision of Dr. Jose Salguero (defendant), prescribed Avery the antidepressant Celexa, despite the black box warning advising that it not be prescribed to adolescents.

At the time of the prescription, court documents further state, there was no discussion with Avery or her mother regarding the black box warning, and they were not informed that they should read the package insert or closely monitor Avery while she was on this drug. Furthermore, they were never informed that Avery should be evaluated by a psychiatrist or psychologist, and no one ever informed Avery or her mother that Celexa was linked to an increased risk of suicide.

Following this initial visit, Avery had one subsequent office visit with Allyn Kawalek, RN, FNP-BC (defendant), where no warnings were mentioned regarding this drug. On August 14, 2012, Avery committed suicide by overdosing on Diphenhydramine. Read this here.

Following her daughter's death, Ginger Thompson obtained a set of Avery's medical records from Dr. Salguero's office. She provided a copy of those records to The Webster Law Firm. However, once Dr. Salguero and his office learned of this suit, Dr. Salguero knowingly altered Avery Washington's medical records so that there were two different sets. During the course of litigation, The Doctors Company, Dr. Salguero's insurance company, made no offer to settle this claim and The Webster Law Firm took this case to trial. After seven days of trial and testimony from the parties and other witnesses, the jury received the case. After nearly three hours of deliberations, the jury returned the following verdict:

PLAY offers more opportunities for hands-on exploration through an animated cube-solving guide, computer programming and robots, and even a color match game for the youngest guests.

INSPIRE encourages guests to experience the Cube's vast artistic and technological influence. From controlling a giant mechanical Rubik's Cube to engineering a musical masterpiece, guests will celebrate the Cube as a muse, metaphor, and pop culture icon.

    UT Physicians Expands Partnership with Babyscripts

    - Babyscripts, the leading prenatal app and the first mobile clinical tool to allow obstetricians to remotely monitor their pregnant patients' progress and health, has announced an expansion with UT Physicians after a successful pilot program.     The Babyscripts mobile app will now be offered to all obstetric patients to enhance their knowledge, experience and clinical care. Babyscripts™ improves the quality of pregnancy care beyond the OB-GYN office visit. The app uses insights and advice approved by the American College of Obstetricians and Gynecologists (ACOG) to support and educate patients throughout their prenatal journey.

    During the initial pilot program, the Houston area was hit by Hurricane Harvey, which was a critical time to provide expectant mothers with up-to-date information regarding care. UT Physicians obstetricians, in addition to the Babyscripts team, were able to leverage the real-time communication ability of the program to push out important information to patients during the disaster. Over the course of three days, patient engagement in the mobile app increased 430 percent, driven by multiple sessions per day.

    "Most of our patients are using online platforms now throughout their pregnancy through social media and apps on their phones," said Brian Heaps, M.D., assistant professor in the Department of Obstetrics, Gynecology and Reproductive Sciences at McGovern Medical School at UTHealth. "Incorporating Babyscripts, an app that uses information approved by ACOG, is a great way to combine the usefulness of current technology with accurate and local information about our clinical practice and the hospital. It gives us another way to provide the best care to our patients during their pregnancies."

    "Expanding pregnancy resources for our patients with the addition of Babyscripts enhances the patient experience with evidence-based information available at their fingertips," said Joey England, M.D., assistant professor at the medical school and a maternal-fetal medicine specialist. "We wanted to offer a modern tool to improve access to care and patient satisfaction.     Dead Ash Trees Are Not Safe and Giroud Tree and Lawn Urges Removal if Near Homes or Other Valuable Property

    Emerald Ash Borer is a dangerous insect that invades and destroys Ash trees. The fatal pest has killed millions of trees across the country since first appearing in 2002. But Giroud Tree and Lawn explains why the Emerald Ash Borer plague is a big cause for concern- Dead Ash Trees are Not Safe!

    Emerald Ash Borers are fast killers!

    Ash trees infested with Emerald Ash Borers die within 1-3 years. To understand why dead Ash trees are not safe, it is best to first to look at how the Emerald Ash Borer invades and inevitably kills a tree.

    The adult borers swarm the tree and lay eggs under the bark. Once the larvae emerge, Emerald Ash Borers immediately start chewing through the wood of the tree. Imagine veins with blood flowing freely through a body. In much the same way, the veins in the grains of the tree allow water to flow through the tree. When the larvae chew through the wood, it cuts off water circulation. Additionally, the adult Borers create thousands of exit wounds, further causing damage that dries out the tree.

    If more than half of a tree's crown is dead, the Ash tree cannot be saved. Unfortunately, a dead Ash tree quickly becomes a safety hazard. Tree removal will be necessary, especially if the dead Ash is located near a home, driveway or play area.

    Why Are Dead Ash Trees Unsafe?

    Moisture Loss: Emerald Ash Borers cut off the flow of water and nutrients through the tree. Additionally, the fatal pest creates thousands of exit wounds. Both conspire to dry out the tree and make it brittle.

    Removal Must Be Done ASAP

    A dead Ash tree is not a simple tree removal. The brittle tree is so dry that it can break apart in unexpected ways and cause significant damage. The first step is to have the tree evaluated by an ISA Certified Arborist.

    The Arborist will evaluate the tree's condition. The purpose of the evaluation is to determine if a tree climber can safely work in the tree or if a crane and/or bucket truck is required. The longer the dead tree is left in the ground, the drier and more dangerous it becomes, making tree removal even more complicated and expensive.
