Katz, Goldstein & Warren Announces 20 Years of Growth and Change in Matrimonial and Family Law Practice

The law firm of Katz, Goldstein & Warren reached a significant milestone in 2018 by observing its 20th year of practice in matrimonial and family law in Bannockburn, Illinois.

The firm, which primarily serves the upper-income North Shore suburbs of Chicago, has doubled in size during those 20 years, now employing seven lawyers who focus on various aspects of divorce litigation, including complex financial and parenting disputes as well as prenuptial and post-nuptial agreements. The practice of matrimonial law has changed dramatically over the past 20 years, particularly in the past five years. "Both societal trends and changes in the law have had a big impact on our practice. We see couples marrying later and having more pre-marital assets to protect, an increase in divorces among couples over age 55 who are particularly concerned about retirement savings, and the legalization of same-sex marriage with a corresponding rise in same-sex couples with children," said Principal Todd R. Warren.

The landscape of post-divorce childcare has also been altered. "For families with children, the old terms and practices of maternal child custody and paternal visitation have been replaced by a more balanced allocation of parental responsibilities and parenting time," continued Warren. "Parenting agreements are also broader in scope these days, including such matters as who will pay for children's extracurricular activities, college and cars as well as visitation rights for extended family members such as grandparents and non-biological parental figures."

Warren has 30 years of experience in navigating high-asset divorce cases. Ilene B. Goldstein, the firm's other current principal, has almost 35 years in this field. This area of practice requires an attorney to have an acute understanding of how financial changes and tax laws impact divorcing individuals.

"I cannot overstate the value of long-term experience and financial aptitude when handling high-asset divorce negotiations," said Goldstein. "Our clients come to us with a complex mix of business assets, real estate, stock and bond portfolios and retirement accounts. To ensure an equitable division of assets and provide for the long-term needs of our client and their dependents, we have to look at the total financial picture, including asset valuation, cash flow and tax implications."

Goldstein points to a recent change in federal tax law as another reason high-asset couples need attorneys who understand their particular needs. Generally, the payer of spousal support has a substantially higher income than the recipient. For divorces finalized prior to 2019, the payer can deduct spousal support dollars from their taxable income, while the recipient pays the federal income tax on those dollars at a presumably lower tax rate. The new law effectively increases the tax burden on the couple as a whole. For divorces finalized after January 1, 2019, payers of spousal support will pay federal income taxes on their entire income, including spousal support dollars, and recipients will receive those dollars tax-free.

U.S. Consumers Report That Credit Cards Now Their Most Preferred Payment Type in Stores

The most recent Insight Summary Report from Mercator Advisory Group's biannual CustomerMonitor Survey Series, titled U.S. Consumers and Credit: Rising Usage, reveals that 62% of U.S. households use credit cards in 2018, up from 60% of U.S. Households in 2017. Rising use of online shopping appears to make credit cards more attractive, as the survey also finds that U.S. consumers are now more likely to prefer using credit cards rather than debit cards or any other payment type at online retailers, for online travel, digital content, and even online bill payments than since we started tracking usage preference in 2015.

Debit cards, however, are often preferred for small purchases and everyday in-store spending such as groceries. But when consumers were asked to choose their single most preferred payment type in stores, 36% prefer credit cards and 33% prefer debit, the top two payment types, followed by 18% who prefer using cash. Surprisingly, the preference for cash remains strong, particularly among Gen Z young adults aged 18 to 24 who, since the CARD Act of 2009, are less likely than older adults to use credit cards. This study also finds that consumers using credit cards are more likely than ever to be paying their monthly balances in full, though young adults are less likely than average to do so.

The report presents the findings from Mercator Advisory Group's CustomerMonitor Survey Series online panel of 3,002 U.S. adult consumers surveyed in June 2018. The study examines the demographic distribution of credit card use in the United States, use of co-branded credit or charge card programs by type, changing patterns of credit card use relative to other payment types, credit card payment habits, and self-assessed credit history, as well as notice of and reaction to merchant steering practices, usage of peer-to-peer lenders by brand and reasons for use, consumer experience of changing fees, APRs, motivators to increase credit card borrowing and credit card spending, methods used to shop for new credit cards, application channels used for general purpose credit cards and store credit cards, and consumers' notice of and reaction to merchant rules for credit card use and interest in mobile-based account controls.

"In 2018, credit cards rewards and online shopping appear to be driving stronger use of general purpose network branded credit cards, especially since 3 in 10 credit cardholders say they use premium credit card s that have an annual fee. Consumers recognize the security that credit cards offer particularly online. When it comes to fraud and disputed charges, it's easier to deal with when the money is borrowed from the issuer, and not their own," stated Karen Augustine, manager of Primary Data Services, including CustomerMonitor Survey Series, at Mercator Advisory Group, the author of the report.

Gluten-Free Certification Adds Plant-Based Certification To Meet Consumer Trends

As a BRC Global Standards company, Allergen Control Group (ACG), owners of the Gluten-Free Certification Program (GFCP), are excited to announce the formation of two food-industry stakeholder working groups to support the development and launch of the first internationally recognized and voluntary Plant-Based Certification Program (PBCP). A limited number of seats are still available for participation from key brand owners, grocery retailers and manufacturers. The first face-to-face sessions will be hosted in both North America and Europe, towards the end of February 2019.

With the ever-changing regulatory landscape, and increased consumer demands, brands and manufacturers are even more challenged when making sound and trustworthy specialty-food product claims. "Although, there appears to be little or no current regulations around these claims, our PBCP will be designed to enable consumers to make safe and informed choices, while also meeting the current and future practical needs of our industry," states Paul Valder, president & CEO at Allergen Control Group.

"The key message for the customer related to our PBCP is to communicate that making a plant-based consumer claim is all about food and diet, where vegan claims are strictly a lifestyle. Consumers today want to incorporate plant-based foods into their diet, but do not consider themselves vegan," explains Katie Daniels, Technical Program Manager at ACG. Ms. Daniels goes on to state that "retailers, brands and manufacturers around the globe can now gain operational and financial efficiencies, by combining their existing annual third-party food safety audit, together with both our gluten-free and plant-based certification programs."
As more and more consumers are incorporating plant-based foods into their diets, they are also increasingly discerning when faced with endless product options. When implemented and verified at the manufacturing stage, the PBCP will then be the trusted "on-pack" trademark/symbol to attract customers, differentiate products, build trusted brand loyalty and protect the brand reputation, associated with making such a claim.
